TITLE OF BILL:
An act to amend the state finance law and the general municipal law, in
relation to prohibiting procurement of certain technology that poses
security threats; and to amend a chapter of the laws of 2025 amending
the state finance law and the general municipal law relating to prohib-
iting procurement of certain technology that poses security threats, as
proposed in legislative bills numbers S. 3259 and A. 2237, in relation
to the authority of the office of information technology services to
issue certain guidance relating thereto
 
PURPOSE:
This is a chapter amendment that makes changes to L.2025, C.683.
 
SUMMARY OF PROVISIONS:
This legislation amends the underlying chapter by aligning the defi-
nition of technology in these sections of law with an existing defi-
nition of technology in the State Finance Law; limiting the ability to
grant waivers to the Office of Information Technology; requiring locali-
ties seeking federal waivers to inform the Office of Information Tech-
nology; exempting from the ban any drones using United States maintained
software, that store their data in the US, and that prevent any compa-
nies subject to the ban from accessing data; and requiring the Office of
Information Technology to issue the necessary guidance without having to
go through the formal regulations process.
 
JUSTIFICATION:
This legislation is a negotiated change to the underlying chapter.

EFFECTIVE DATE:
This act shall take effect immediately; provided, however, that sections
one, two and three of this act shall take effect on the same date and in
the same manner as a Chapter of the Laws of 2025 amending the State
Finance Law and the General Municipal Law relating to prohibiting
procurement of certain technology that poses security threats, as
proposed in legislative bills numbers S.3259 and A.2237, takes effect.
