TITLE OF BILL:
An act to amend the public health law, in relation to conditions under
which non-public residential health care facilities may withdraw equity
or assets totaling five percent of total reported annual revenue for
patient care services without prior notification; and to amend a chapter
of the laws of 2025 amending the public health law relating to equity
withdrawals by non-public residential health care facilities, as
proposed in legislative bills numbers S. 5369 and A. 2051, in relation
to the effectiveness thereof
PURPOSE OF BILL:
This is a chapter amendment that makes changes to the provisions of
L.2025, C.695.
SUMMARY OF SPECIFIC PROVISIONS:
This legislation amends the underlying chapter to exclude private non-
public nursing homes under the Special Focus Facility program, nursing
homes subject to the denial of payment from Medicaid and Medicare, and
nursing homes subject to enforcement action by the department in the
last 18 months that resulted in a finding of deficiency from making
equity withdrawals. The chapter amendment also adjusts the effective
date to immediately for section 1, and effective one year after it
becomes law for sections 2 and 3 of this bill.
JUSTIFICATION:
This legislation is a negotiated change to the underlying chapter.

FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENT:
None.
EFFECTIVE DATE:
This act shall take effect immediately; provided, however that section
one of this act shall take effect on the same date and in the same
manner as a chapter of the laws of 2025 amending the public health law
relating to equity withdrawals by non-public residential health care
facilities, as proposed in legislative bills numbers S.5369 and A.2051,
takes effect.
