TITLE OF BILL:
An act to amend the general business law, in relation to the definition
of the term employer and to the requesting or use for employment
purposes of the consumer credit history of an applicant for employment
or employee by an employer, labor organization, employment agency or any
agent thereof; and to repeal certain provisions of a chapter of the laws
of 2025 amending the general business law relating to prohibiting the
disclosure or use of a person's consumer credit history to an employer,
labor organization, employment agency or agent thereof for purposes of
employment decisions
PURPOSE:
This is a chapter amendment to L.2025, c.681, to add a definition of
"employer" that includes the state and its political subdivisions, and
make technical amendments.
SUMMARY OF PROVISIONS:
This legislation amends the underlying chapter amendment by adding a
definition of "employer" that includes the state and its political
subdivisions. The legislation removes provisions regarding a carve out
for a high degree of public trust positions.
EXISTING LAW:
None.
JUSTIFICATION:
This legislation is a negotiated change to the underlying chapter.
LEGISLATIVE HISTORY:
Chapter amendment to Chapter 681 of the Laws of 2025. S.3072 and A.1316,
both passed the Senate and Assembly, respectfully, in April and May
2025.
FISCAL IMPLICATIONS:
None
EFFECTIVE DATE:
This act shall take effect on the same date and in the same manner as a
chapter of the laws of 2025 amending the general business law, in
relation to the definition of the term employer and to the requesting or
use for employment purposes of the consumer credit history of an appli-
cant for employment or employee by an employer, labor organization,
employment agency or any agent thereof, as proposed in legislative bills
numbers S.3072 and A.1316, takes effect.
