BILL NUMBER: S8786
SPONSOR: SKOUFIS
TITLE OF BILL:
An act to amend the insurance law, in relation to the kinds of insurance
with respect to which a rental vehicle company or peer-to-peer car shar-
ing program administrator may act as an agent for an authorized insurer
PURPOSE:
This bill makes clarifying chapter amendments to the peer-to-peer car-
sharing statute.
SUMMARY OF PROVISIONS:
Section 1: Amends subsection (d) of section 2131 of the Insurance Law to
make clarifying amendments that conform with the intent to ensure that
peer-to-peer car sharing programs maintain insurance protections in a
manner more similar to rental car companies.
Section 2: Sets effective date.
JUSTIFICATION
:
THE UNDERLYING CHANGE BRINGS INSURANCE REQUIREMENTS FOR THE PEER-TO-PEER
CAR-SHARING INDUSTRY MORE IN LINE WITH TRADITIONAL RENTAL CAR COMPANIES,
CREATING PARITY BETWEEN THE INDUSTRIES. THIS ENSURES THAT PEER-TO-PEER
CAR-SHARING PROGRAMS ARE NOT SUBJECT TO STRICTER REQUIREMENTS THAN
RENTAL CAR COMPANIES.
LEGISLATIVE HISTORY:
NEW BILL 2025: UNDERLYING BILL (S.5941-B/SKOUFIS) PASSED BOTH HOUSES.
FISCAL IMPLICATIONS:
NONE
EFFECTIVE DATE:
THIS ACT SHALL TAKE EFFECT IN THE SAME TIME AND MANNER AS THE UNDERLYING
BILL, WHICH TAKES EFFECT 180 DAYS AFTER BEING SIGNED INTO LAW.
