TITLE OF BILL:
An act to amend the social services law, in relation to providing guid-
ance to certain staff accepting registrations, issuing licenses or
conducting inspections of child day care homes, programs or facilities
on the identification of circumstances that may indicate the presence of
controlled substances and referrals to law enforcement; and to amend a
chapter of the laws of 2025 amending the social services law relating to
training certain staff accepting registrations, issuing licenses or
conducting inspections of child day care homes, programs or facilities
on the recognition of controlled substances, as proposed in legislative
bills numbers S. 6226 and A. 1382, in relation to the effectiveness
thereof
PURPOSE:
This chapter amendment clarifies provisions of L.2025, C.619.
SUMMARY OF PROVISIONS:
This legislation amends the underlying chapter on staff training for
child day care homes, programs, and facilities to identify circumstances
indicating the presence of controlled substances.
Section 1 amends the underlying chapter by removing the requirement that
childcare licensing and inspection staff be trained to recognize
controlled substances. It introduces a new requirement for staff to
receive guidance on identifying circumstances that may indicate the
presence of controlled substances, rather than identifying the
substances themselves.
Section 1 also adds explicit guidance on making referrals to law
enforcement when such circumstances are identified.
Lastly, this legislation amends Section 2 of the underlying chapter,
amending the effective date from immediately to the one hundred eight-
ieth day after it becomes law.
JUSTIFICATION:
This legislation is a negotiated change to the underlying chapter.

EFFECTIVE DATE:
This act shall take effect immediately; provided however, that section
one of this act shall take effect on the same date and in the same
manner as a chapter of the laws of 2025 amending the social services law
relating to training certain staff accepting registrations, issuing
licenses or conducting inspections of child day care homes, programs or
facilities on the recognition of controlled substances, as proposed in
legislative bills numbers S. 6226 and A. 1382, takes effect.
