TITLE OF BILL:
An act to amend the social services law, in relation to prohibiting the
use of infant walkers in child care facilities; and to repeal section
399-kk of the general business law relating to prohibiting the sale of
infant walkers and restricting the use of such infant walkers in certain
settings
PURPOSE:
This is a chapter amendment to L.2025, c.629, to place the law in the
social services law,and prohibit the use of infant walkers in child care
facilities.
SUMMARY OF PROVISIONS:
This legislation amends the underlying chapter by moving the law from
the General Business Law to the Social Services Law, repeal the broad
infant walkers ban and associated penalties, apply the ban to only child
care facilities, and repeal the associated rulemaking authority granted
to the Office of Children and Family Services.
EXISTING LAW:
None.
JUSTIFICATION:
This legislation is a negotiated change to the underlying chapter.
LEGISLATIVE HISTORY:
Chapter amendment to Chapter 629 of the Laws of 2025. S.123 and A.268,
both passed the Senate and Assembly, respectfully, in June 2025.
FISCAL IMPLICATIONS:
None
EFFECTIVE DATE:
This act shall take effect on the same date and in the same manner as a
chapter of the laws of 2025 amending the social services law, in
relation to prohibiting the use of infant walkers in child care facili-
ties, as proposed in legislative bills numbers S.123 and A.268, takes
effect.
