TITLE OF BILL:
An act to amend the county law, in relation to mandatory continuing
education requirements for coroners and coroner's deputies; and to amend
a chapter of the laws of 2025, amending the county law relating to
mandatory continuing education requirements for coroners and coroner's
deputies, as proposed in legislative bills numbers S. 3637 and A. 4014,
in relation to the effectiveness thereof
 
PURPOSE:
This is a chapter amendment that makes changes to L.2025, C.648.
 
SUMMARY OF PROVISIONS:
This legislation amends the underlying chapter by preserving the author-
ization for the Department of Health ("the Department") to consult with
qualified professional groups, while removing the reference to the New
York State Association of County Coroners and Medical Examiners as a
qualified professional group with which the Department may consult.
The requirement for a coroner and coroner's deputy to register trienni-
ally with the Department is removed and replaced with a requirement that
each coroner or coroner's deputy must: (1) attest to their respective
county, and to the Department upon request, their successful completion
of continuing education; (2) maintain records of compliance for seven
years, and; (3) file the attestations in the office of the County Clerk.
The one-year exemption from the mandatory continuing education require-
ment for each coroner or coroner's deputy is modified to follow the
successful completion of the state-approved courses in medical-legal
investigation, rather than to follow the date on which they are first
elected or appointed.
The obligation of the Department to issue certificates of completion and
to adjust the mandatory continuing education requirements are removed.
Counties are authorized to temporarily waive continuing education
requirements for extended active duty with the Armed Forces, or for no
longer than one year for other good cause. The effective date is modi-
fied from 180 days to one year.
 
JUSTIFICATION:
This legislation is a negotiated change to the underlying chapter.

EFFECTIVE DATE:
This act shall take effect on the same date and in the same manner as a
chapter of the laws of 2025 amending the County Law relating to mandato-
ry continuing education requirements for coroners and coroner's depu-
ties, as proposed in legislative bills numbers S.3637 and A.4014.
