TITLE OF BILL:
An act to amend the agriculture and markets law, in relation to estab-
lishing a New York native plants designation; to repeal certain
provisions of such law relating thereto; and to amend a chapter of the
laws of 2025 amending the agriculture and markets law relating to estab-
lishing a New York native plants designation, as proposed in legislative
bills numbers S. 7359-A and A. 7964-A, in relation to the effectiveness
thereof
 
PURPOSE OF BILL:
This is a chapter amendment that makes changes to provisions of L.2025,
C.702
 
SUMMARY OF SPECIFIC PROVISIONS:
This legislation amends the underlying chapter to clarify the agencies,
stakeholders, and parameters for establishing a "native plants" desig-
nation under the New York Grown and Certified program, which will create
seals and educational materials for native plants and create a list of
native plants eligible for the New York Grown and Certified program.
 
JUSTIFICATION:
Pursuant to approval memo 78 of 2025, the Executive and Legislature have
reached agreement on modifications to the underlying chapter.

Chapter amendment to Chapter 702 of the Laws of 2025.
 
FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS:
This bill would be implementing a change in policy that places minimal
new costs on the State and no new costs on localities.
 
EFFECTIVE DATE:
This act shall take effect immediately; provided, however, that sections
one and two of this act shall take effect on the same date and in the
same manner as a chapter of the laws of 2025 amending the agriculture
and markets law relating to establishing a New York native plants desig-
nation, as proposed in legislative bills numbers S. 7359-A and A. 7964A,
takes effect.
