TITLE OF BILL:
An act to amend the public service law, in relation to consideration of
capital expenditures by a utility proposing a major change in rates
 
PURPOSE OF BILL:
This is a chapter amendment that makes changes to provisions of L.2025,
C.622
 
SUMMARY OF SPECIFIC PROVISIONS:
This legislation amends the underlying chapter to limit the application
of this bill to a major change in rates and clarifies that the PSC shall
consider the operation of the distribution system among other factors
when examining capital expenditures.
 
JUSTIFICATION:
Pursuant to approval memo 17 of 2025, the Executive and Legislature have
reached agreement on modifications to the underlying chapter.

EFFECTIVE DATE:
This act shall take effect on the same date and in the same manner as a
chapter of the laws of 2025 amending the public service law relating to
utility capital expenditures, as proposed in legislative bills numbers
S.8213 and A.2736-A.
