TITLE OF BILL:
An act to amend the general business law, in relation to prohibiting
unfair residential real estate service agreements
 
PURPOSE:
This is a chapter amendment to L.2025, c.634, to amend the scope of
applicable contracts.
 
SUMMARY OF PROVISIONS:
This legislation amends the underlying chapter amendment by adding to
the list of types of agreements that may not be considered an unfair
real estate service agreement to include "contracts, restrictive decla-
ration, regulatory agreement or other instrument, which is mandated by a
governmental entity or to which a governmental entity is a party."
 
EXISTING LAW:
None.
 
JUSTIFICATION:
This legislation is a negotiated change to the underlying chapter.
 
LEGISLATIVE HISTORY:
Chapter amendment to Chapter 634 of the Laws of 2025. S.6361-B and
A.5886-C, both passed the Senate and Assembly, respectfully, in June
2025.
 
FISCAL IMPLICATIONS:
None
 
EFFECTIVE DATE:
This act shall take effect on the same date and in the same manner as a
chapter of the laws of 2025 amending the general business law, in
relation to prohibiting unfair residential real estate service agree-
ments, as proposed in legislative bills numbers S.6361-B and A.5886-C,
takes effect.
