TITLE OF BILL:
An act to amend the general business law, in relation to penalties for
failure of an operator to return shared electric scooters and bicycles
to a proper location
 
PURPOSE OR GENERAL IDEA OF BILL:
This bill would require daily penalties for failure of an operator to
return shared electric scooters and electric bicycles to a proper
location as specified, designated or directed.
 
SUMMARY OF PROVISIONS:
Section 1. The general business law is amended by adding a new § 390-f
to require any shared bicycle with electric assist system and shared
electric scooter system operating within the state to impose daily mone-
tary penalties on any user or borrower who fails to return the electric
scooter or electric bicycle to the proper location as specified, desig-
nated or directed by the system.
Section 2. Effective date.
 
JUSTIFICATION:
This bill plays a crucial role in promoting public safety, fostering
responsible sharing practices and supporting effective urban planning.
Requiring operators of shared electric bicycles and shared electric
scooters that provide their services in New York State to charge a mone-
tary penalty to users for failure to return the device to designated
locations it will mitigate potential hazards for pedestrians and other
motorists and improve the quality of life.

EFFECTIVE DATE:
This act shall take effect on the thirtieth day after it shall have
become a law.
