TITLE OF BILL:
An act in relation to granting retroactive tier II membership in the New
York state and local police and fire retirement system to Javier-Luis I.
Martinez
 
PURPOSE:
Grants retroactive tier 2 membership to Javier-Luis I. Martinez of the
Town of Colonie
 
SUMMARY OF PROVISIONS:
Section 1 grants tier 2 status in the NYS and local police and fire
retirement system to Javier-Luis I. Martinez.
Section 2 states that all past service costs of implementing the
provisions of this act shall be borne by the town of Colonie, and there
shall be no refund of member contributions.
Section 3 authorizes this act to take effect immediately.
 
JUSTIFICATION:
Javier-Luis I. Martinez has been a dedicated police officer for the Town
of Colonie for over ten years. In 2022, Javier Martinez won the "2022
Albany Bridge Builder Award" from the Albany Law Enforcement Resolution
Team. This award was in recognition of Javier's tireless work "to make
Colonie community a better, safer and healthier place to live. Javy was
recognized for his never-ending dedication to duty, his numerous awards
earned serving the community and his time spent coaching young adults
with developmental disabilities through the Wildwood Undisputed Cham-
pions boxing program."
Prior to his time as a police officer for the Town of Colonie, Javier
Martinez was employed by the Town of Colonie as a Youth Court Program
Assistant for 4 years. Through no fault of his own, Javier did not
enroll at that time of employment to the NYS and local employees'
retirement system. It wasn't until his new employment in July of 2013
that he enrolled. This legislation would grant retroactive tier 2
membership to Javier, starting on the date he first began working for
the Town of Colonie in 2008.

FISCAL IMPLICATIONS:
Fiscal note attached; past service cost of approximately $4,610 which
will be borne by the town of Colonie as a one-time payment.
