TITLE OF BILL:
An act in relation to granting retroactive membership with Tier IV
status in the New York state and local employees' retirement system to
Philip Apruzzese
 
PURPOSE:
Grants retroactive tier 4 membership to Philip Apruzzese
 
SUMMARY OF PROVISIONS:
Section 1 Grants Philip Apruzzese Tier IV status
Section 2 states that service costs associated with granting Philip
Apruzzese Tier IV status shall be borne by the Town of Yorktown
Section 3 This act shall take effect immediately
JUSTIFICATION:
Philip Apruzzese, a resident of Latham, is currently a Tier 5 member of
the New York State retirement system. He joined the retirement system in
August of 2010. Under Tier 5 rules, he cannot retire with full benefits
until age 62, despite reaching 30 years of service at age 56.
Philip previously served as a camp counselor for Yorktown Heights from
June 25th, 2001 through July 27th, 2001 and June 27th, 2002 through
August 2nd, 2002. He purchased that service,however, he did not enroll
in the retirement at that time due to being under 18 and unaware of the
need to opt in. Because of this, he was placed in Tier 5 instead of Tier
4.
This legislation would grant Philip Apruzzese Tier IV status.
