TITLE OF BILL:
An act to amend the civil practice law and rules, in relation to certain
actions arising from construction defects in condominiums
PURPOSE OR GENERAL IDEA OF BILL:
This bill sets rules and regulations for the resolution of condominium
construction defect complaints
SUMMARY OF PROVISIONS:

JUSTIFICATION:
Condominiums can be a key tool to fighting the housing cost crisis.
Residential units for ownership in multi-family buildings are often
cheaper due to shared infrastructure than single family homes. They are
also more likely to be in walkable and pedestrian friendly neighbor-
hoods, where it is families need fewer cars, greatly saving on transpor-
tation cost. Bringing down the cost of condominium development will
allow for more affordable housing options for ownership.
One key way other states have looked at to reduce insurance costs and
increase condominium production is to set out a clear, consistent proc-
ess for resolving construction defect complaints. This bill is modeled
after a similar proposal that passed the Colorado legislature.' The bill
lays out a clear process for condominium owners to get the resolution
they deserve on condo construction defects, while establishing predict-
ability in the process to helps fight insurance costs for building
condos.
