TITLE OF BILL:
An act to amend the alcoholic beverage control law, in relation to an
exemption for certain property from the prohibition of alcohol sales
within a certain distance from a church
PURPOSE:
To waive the ABC 200 Foot Rule with respect to a certain designated
entity, such entity having the assent of the affected institution.
SUMMARY OF PROVISIONS:
Waives the ABC 200 Foot Rule with respect to a certain designated entity
at '341 Lenox Ave, New York, NY 10027, such entity having the assent of
the affected institution.
JUSTIFICATION:
The Harlem Shark Bar currently operates at a location- 341 Lenox Ave,
New York, NY 10027-the previous commercial use of which was a bar with a
full ABC License that was approved by the SLA. The owners of the Shark
Bar therefore assumed they would have no issue getting the same type of
Liquor License as there had been no material changes. In SLA's investi-
gatory review they discovered the existence of property belonging to a
religious institution within 200 feet. As reported by the religious
institution, the property in question is only used for administration,
not religious services and they have no objection to the issuance of a
Liquor License. This bill is needed to implement a resolution satisfac-
tory to all.
