TITLE OF BILL:
An act to amend the racing, pari-mutuel wagering and breeding law, in
relation to permitting requests for self-exclusion from gambling to be
made electronically
PURPOSE OR GENERAL IDEA OF BILL:
The purpose of this bill is to modernize the self-exclusion process by
allowing individuals to submit requests for voluntary self-exclusion
electronically, rather than requiring in-person and notarized paper
submissions only.
SUMMARY OF PROVISIONS:
Section 1 of the bill amends subdivision 2 of Section 1344 of the
racing, pari-mutuel wagering and breeding law to explicitly authorize
the New York State Gaming Commission to accept applications for volun-
tary self-exclusion through secure electronic means, including, but not
limited to, online portals, mobile applications, and other verified
digital platforms.
Section 2 provides the effective date.
JUSTIFICATION:
New York law provides for self-exclusion as a vital harm-reduction tool
for individuals struggling with problem gambling. However, current law
requires individuals to print out and complete paper form, have their
signature witnessed by a notary public, and then physically present
themselves with the paper form at the Gaming Commission's office in
Schenectady, New York, or at a licensed gaming facility in New York. If
an individual is unable to travel, that individual may request an accom-
modation from the Gaming Commission to mail the notarized form to the
Gaming Commission. This process creates unnecessary barriers to access.
Other jurisdictions, including New Jersey, Pennsylvania, Michigan, and
Ohio, allow individuals to enroll in self-exclusion lists online through
secure digital platforms. Allowing electronic requests would make New
York's program more accessible and would provide immediate protections
for individuals seeking to limit their gambling activity. Expanding
access to self-exclusion electronically is consistent with New York's
commitment to responsible gaming and problem gambling prevention. This
bill reflects modern realities and ensures that individuals can take
swift, effective action to protect themselves.
