TITLE OF BILL:
An act to amend the real property law, in relation to enacting the
central air conditioner and heat pump rights act
SUMMARY OF PROVISIONS:
Section 1 amends the real property law by adding a new section 9-E to
prohibit in deeds, contracts, HOA bylaws, and security agreements
restrictions on installation of central air conditioners and heat pumps
Section 2 provides the effective date
JUSTIFICATION:
Central air conditioners and heat pumps offer major improvements in
energy efficiency. Homeowners and shareholders should be free to install
these systems because they provide environmental benefits that will help
New York meet its climate goals. This legislation is modeled after two
other recently added articles that similarly remove barriers to the
installation of climate-friendly technology like solar panels and elec-
tric vehicle chargers.
