TITLE OF BILL:
An act to amend the labor law, in relation to requiring reporting on
merit determinations relating to unfair labor practices and a certif-
icate of compliance to be eligible for state economic incentives
 
PURPOSE:
To ensure employers seeking or renewing economic incentives provide
proof of compliance to labor laws before receiving any economic incen-
tives.
 
SUMMARY OF PROVISIONS:
Section 1: creates a new section (§ 45) to the labor law, which details
the actions that need to be taken by employers when seeking and renewing
economic incentives from the state.
Section 2: establishes the effective date.
 
JUSTIFICATION:
Employers who wish to receive benefits from the state should be more
closely reviewed and held accountable if they are practicing unsafe and
unfair work practices, before being considered for said benefits. Labor
laws are supposed to protect employees from being exploited and unless
employers are being held accountable for maintaining fair working prac-
tices, unfair practices will continue.
Economic incentives are meant to benefit both the employers and the
employees. Economic incentives are funded with public dollars, therefore
ensuring the employers who utilize them to make a project viable are
held to the highest labor standards is essential. By creating this
compliance/reporting mechanism, granting agencies can request or review
their compliance with state and federal labor standards before making a
decision about whether or not to award future state economic development
resources.

EFFECTIVE DATE:
This law shall take effect on the one hundred eightieth day after it
shall have become a law. Effective immediately, the addition, amendment
and/or repeal of any rule or regulation necessary for the implementation
of this act on its effective date are authorized to be made and
completed on or before such effective date.
