TITLE OF BILL:
An act to amend the military law, in relation to covered operations with
regard to certain calculations of compensation
PURPOSE OR GENERAL IDEA OF BILL:
To align the definition of Covered Operation for National Guard members
in New York with the federal definition of active service.
SUMMARY OF PROVISIONS:
Section 1- Modifies § 242 of the military law to align the definition
"covered operations" for national guard as those outlined in 10 USC §
101 (d)(3).
Section 2- Establishes the effective date.
JUSTIFICATION:
Currently, the Extended Military Benefits Program limits "covered oper-
ations" to missions tied directly to homeland security (ie: Operation
Iraqi Freedom, Operation Enduring Freedom, etc.). The term "homeland
security" itself is not defined in NYS law. This leaves local agencies
to question - and, in some cases, deny- differential pay for Guardsmen
and Reservists who deploy on missions that are not explicitly related to
9/11, Iraq, or Afghanistan.
PRIOR LEGISLATIVE HISTORY:
New legislation.
EFFECTIVE DATE:
This act shall take effect immediately.
