TITLE OF BILL:
An act to amend the environmental conservation law, in relation to
extending the exemption of certain chemicals used in mattresses from
regulation for an additional year
 
PURPOSE OR GENERAL IDEA OF BILL:
Extends an exemption relating to the use of certain chemicals used in
mattresses from regulation for an additional year.
 
SUMMARY OF PROVISIONS:
Section 1 amends section 37-1005 of the environmental conservation law
as added by chapter 829 of the laws of 2021 to extend the exemption of
textiles made using modacrylic fiber components without antimony triox-
ide in memory foam or gel foam mattresses as well as aramid fibers when
used on the bottom, non-sleeping side of a mattress for one year. Such
exemption will expire on January 1, 2027.
Section 2 provides the effective date.
 
JUSTIFICATION:
The New York Family and Fire Protection Act of 2021 prohibits the sale
of new mattresses and upholstered furniture that contain specific flame
retardant chemicals such as halogenated and nanoscale flame retardants.
The act includes a five-year exemption for the use of modacrylic fiber
components without antimony trioxide when used in specific mattresses
and aramid fibers when used on the bottom, non-sleeping side of a
mattress. This exemption is currently set to expire on January 1, 2026.
This bill seeks to extend the exemption by one year, moving the expira-
tion date to January 1, 2027.
