TITLE OF BILL:
An act to amend the executive law, in relation to terms and conditions
of employment for members of the collective negotiating unit consisting
of investigators, senior investigators, and investigative specialists in
the division of state police; to amend the state finance law, in
relation to the employee benefit fund for members of such unit; to
repeal certain provisions of the executive law and the state finance law
relating thereto; and making an appropriation therefor
 
PURPOSE OF THE BILL:
This bill would implement the provisions of a collective bargaining
agreement between the Executive Branch of the State of New York and the
employee organization which represents members of the collective negoti-
ating unit consisting of investigators, senior investigators and inves-
tigative specialists in the Division of State Police (hereinafter
"members of the BCI unit") for the period covering April 1, 2023 to
March 31, 2026, entered into pursuant to Article 14 of the Civil Service
Law.
 
SUMMARY OF PROVISIONS OF THE BILL:
Section 1 of this bill would repeal Executive Law § 216(3)(a) and
replace it with a new salary schedule for members of the BCI unit. The
new salary schedules include a 3 percent increase in basic annual salary
effective April 1, 2023, April 1, 2024, and April 1, 2025.
Section 2 of the bill would repeal State Finance Law § 207-b(2)(b) and
replace it with a new paragraph that continues payments to the Employee
Benefit Fund for members of the BCI unit.
Section 3 of the bill would repeal Executive Law § 216-b(5) and replace
it with a new subdivision that continues and increase longevity payments
consistent with the agreement.
Section 4 of the bill would repeal Executive Law § 216-c(2) and replace
it with a new subdivision that continues and increases holiday payments.
Section 5 of the bill would continue and increase funding for the
committee on health benefits.
Section 6 of the bill would continue and increase the maintenance allow-
ance for members of the BCI unit.
Section 7 of the bill would continue and increase expertise pay for
members of the BCI unit in accordance with the terms of the collectively
negotiated agreement.
Section 8 of the bill would continue and increase funding for the
professional development and quality of working life committee to
support the tuition reimbursement program, the master's program, changes
to the LATS system and the employee assistance program.
Section 9 of the bill would continue the payment of expanded duty pay
and increase such payments in accordance with the terms of the collec-
tively negotiated agreement.
Section 10 of the bill would continue supervisory responsibility pay in
accordance with the terms of both an interest arbitration award dated
February 4, 2005, issued pursuant to Civ. Serv. Law § 209(4), and the
recently negotiated agreement for members of the BCI unit designated as
"Unit Coordinators", "Acting Senior Investigators" or "Acting Adminis-
trative Senior Investigators."
Section 11 of the bill would continue and increase location compensation
for members employed in New York City or in the counties of Orange,
Putnam, Dutchess, Rockland, Westchester, Nassau and Suffolk. It would
also continue location compensation for eligible members in the county
of Monroe.
Section 12 of the bill would continue and increase supplemental location
pay for members of the BCI unit employed in New York City or in the
counties of Orange, Putnam, Dutchess, Rockland, Westchester, Nassau and
Suffolk in accordance with the terms of the collectively negotiated
agreement.
Section 13 of the bill would continue seniority pay for members of the
BCI unit who have achieved eight years of service and establish the
right to such pay upon the taking and placement on the sergeant's list
for such members of the unit.
Section 14 of the bill would continue the lump sum payment for unused
sick leave at retirement.
Section 15 of the bill would provide that eligible members of the BCI
unit shall receive a lump sum payment in the amount of $3,000 consistent
with the terms of the agreement.
Section 16 of the bill would continue a payment to members of the BCI
unit who possess or obtain a recognized degree.
Section 17 of the bill would continue to provide a payment to eligible
members of the BCI unit who are required to work short swings.
Section 18 of the bill would authorize the State to pay a referral bonus
to sworn members of the State Police consistent with any agreement
reached to pay such bonus, or, where the authorization for such bonus is
extended to unrepresented employees within the Division of State Police
by the Director of Employee Relations.
Section 19 of the bill would continue recall overtime provisions for
eligible members of the BCI unit consistent with the terms of the
collectively negotiated agreement.
Sections 20 through 27 of the bill would provide for payment and publi-
cation of grievance arbitration settlements and awards, certification of
the agreement, payment of the collectively negotiated salary increases,
use of appropriations, appropriation amounts and the effective date.
 
EXISTING LAW:
The last pay bill for the BCI unit, covering the period April 1, 2018 to
March 31, 2023, was enacted by Chapter 337 of the Laws of 2019. Section
216 of the Executive Law contains the current salary schedules for
Investigators, Senior Investigators and Investigative Specialists in the
Division of State Police. Section 207-b of the State Finance Law author-
izes payments to an employee benefit fund on behalf of the members of
the BCI unit. Sections 216-b and 216-c of the Executive Law authorize
payments for longevity and holiday pay, respectively.
 
JUSTIFICATION:
Enactment of this bill is necessary to implement the terms of a collec-
tive bargaining agreement negotiated between the Executive Branch of the
State of New York and the employee organization representing members of
the BCI unit. Such agreement is for the period April 1, 2023 to March
31, 2026. In accordance with Article 14 of the Civil Service Law, the
Agreement is binding on all parties to it. This bill incorporates the
terms of that Agreement related to salary increases and benefit modifi-
cations and appropriates funds necessary to pay for it, in accordance
with the State's obligations.
 
BUDGET IMPLICATION:
This bill would provide appropriations totaling approximately $44
million to pay for the cost of the Agreement during the period April 1,
2023 to March 31, 2026.
 
EFFECTIVE DATE:
This bill would take effect immediately and would be deemed to have been
in full force and effect on and after April 1, 2023.
