TITLE OF BILL:
An act to amend the alcoholic beverage control law, in relation to
creating a special on-premises license for certain properties
 
PURPOSE:
Creates a special on-premises license for certain properties
 
SUMMARY OF PROVISIONS:
Section 1: The alcoholic beverage control law is amended by adding a new
section 97-e. This new section establishes a special on-premises liquor
license for certain properties, allowing individuals to apply for
permission to sell liquor, wine, beer, and cider for on-site consumption
at qualifying facilities. To be eligible, a facility must be located
within a designated industrial or economic zoning district, have at
least 20,000 square feet of floor space, be used for hosting enter-
tainment, cultural, social, or community events, and be situated at
least 500 feet from any residential building. Licenses granted under
this section must comply with all applicable provisions of the Alcoholic
Beverage Control Law, unless inconsistent with this section, and may be
subject to additional rules set by the liquor authority.
Section 2: Sets effective date.
 
JUSTIFICATION:
This legislation would authorize the New York State Liquor Authority to
grant 24-hour on-premises liquor licenses in certain qualified counties.
It ensures that such licenses are issued only in compliance with exist-
ing distance and saturation regulations set forth in the Alcoholic
Beverage Control Law, maintaining the integrity of local communities
while expanding licensing flexibility.
