TITLE OF BILL:
An act to amend the legislative law, in relation to establishing a
legislative commission on article V conventions of the states
PURPOSE:
Allows the legislature to set procedures for selecting, instructing and
overseeing commissioners for an Article V Convention of States.
SUMMARY OF PROVISIONS:
1. Section 1 amends the legislative law by adding a new section, section
83-o to provide for a Legislative commission on article v conventions of
the states and the rules governing. Nine commissioners are to be
appointed from the legislature and must meet qualifications set by this
legislation, including being registered to vote in this state, been a
citizen of the United States for at least five years or has not had any
felony convictions in the prior ten years. This legislation also sets
forth the duties of the commissioners in how they should vote at the
convention and sets potential penalties for any violations of their
duties.
2. Section 2 sets the effective date.
JUSTIFICATION:
This legislation is a companion to the Convention of States resolution
and allows the legislature to appoint nine commissioners to represent
the State of New York at a potential Convention of States.

EFFECTIVE DATE:
This act shall take effect immediately; provided, however, that the
amendments to article 5-A of the legislative law made by section one of
this act shall not affect the repeal of such article and shall be deemed
repealed therewith.
