TITLE OF BILL:
An act to amend the alcoholic beverage control law, in relation to
requiring five feet of distance between alcoholic and nonalcoholic
beverages
 
SUMMARY OF PROVISIONS:
Section 1. Section 105 of the alcoholic beverage control law is amended
by adding a new subdivision 23-a to read as follows: 23-a. Each retail
licensee of liquor and/or wine for consumption off the premises shall be
prohibited from placing such liquor and/or wine for sale within five
feet of nonalcoholic beverages.
 
JUSTIFICATION:
SAFE in Harlem conducted an Alcohol Outlet Density Mapping Initiative
that revealed many local stores place soft drinks and alcoholic beverag-
es in the same coolers.' Additionally, several soft drinks and alcoholic
beverages made by the same manufacturer have nearly identical cans.
Because of this, minors can mistakenly grab an alcoholic beverage and
since the cans are similar, the cashiers often do not realize this
mistake.
This legislation is designed to stop can confusion between alcoholic and
nonalcoholic beverages by establishing a 5-foot separation between alco-
hol and nonalcoholic beverages.
This issue was brought to our attention by three students, from Safe in
Harlem during an OASAS Prevention Week event.
