TITLE OF BILL:
An act to amend the retirement and social security law, in relation to
military service qualifying for military service credit
PURPOSE:
To allow individuals to purchase up to 3 years of service without
consideration of service purchased under section 242 of the military
law.
SUMMARY OF PROVISIONS:
Section 1: amends the retirement and social security law to exclude
from the credit limit of 3 years any service credit granted under 242 of
the military law.
Section 2 shall take effect immediately.
JUSTIFICATION:
New York law allows veterans to purchase service credit in the public
retirement system for the period of their military service. Currently,
they can purchase service credit for up to three years of military
service; however that is reduced by any service credited under section
242 of the Military Law.
This bill would allow individuals who are eligible for service credit
under Section 1000 of Retirement and Social Security Law (RSSL) to
purchase up to three years of service credit without consideration of
service purchased under Section 242 of the Military Law.
