TITLE OF BILL:
An act to amend the retirement and social security law, in relation to
providing a disability presumption to members of public retirement
systems
 
PURPOSE:
To establish legal presumption of disability in relation to public
retirement systems where eligible disabled members of such systems are
officially recognized as disabled so long as they meet certain require-
ments.
 
SUMMARY OF PROVISIONS:
Section 1 amends the retirement and social security law by adding a new
section 810 which states that a member of a public retirement system who
has been determined to have a permanent disability and is approved for
social security disability benefits shall be deemed disabled for disa-
bility benefits of such public retirement system.
Section 2 is the effective date.
 
JUSTIFICATION:
Public retirement system members who have already been determined,
through meticulous evaluation, by the New York State Workers' Compen-
sation Board or the Social Security Administration should automatically
be deemed as "disabled" in such public retirement systems.
Having legal presumption in relation to this would promote efficiency by
reducing unnecessary delays and superfluous steps to be required in the
process of receiving disability pensions from said public retirement
systems when such retirees are already confirmed to be disabled.
