TITLE OF BILL:
An act in relation to authorizing the village of Malverne to alienate
and discontinue the use of certain parklands
 
PURPOSE:
To authorize the Village of Malveme to alienate and discontinue the use
of certain parklands for the purpose of building an improved playground
nearby.
 
SUMMARY OF PROVISIONS:
Section 1: Authorizes the Village of Malverne, acting through its
governing body, to discontinue as parklands and alienate the lands
described in section 2 of this act.
Section 2: Provides that this authorization shall be effective only upon
the condition that the Village of Malverne dedicate an amount equal to
or greater than the fair market value of the parklands being discontin-
ued toward the acquisition of new parklands and/or capital improvements
to existing property for park and recreational use.
Section 3: Provides the metes and bounds of the parcel being alienated.
Section 4: Provides further stipulations for the alienation relating to
federal requirements.
Section 5: Provides the effective date.
 
JUSTIFICATION:
This legislation was requested by the Village of Malverne to alienate
the parcel known as Carbone Park so that the Village may move forward
with building out an improved playground at the site of a former Village
Police Station.
