TITLE OF BILL:
An act to amend the public authorities law, in relation to authorizing
the New York state environmental facilities corporation to award grants
and loans to non-public entities for certain water quality projects
SUMMARY OF PROVISIONS:
Section 1 of this bill amends subdivision 2 of section 1283 of the
public authorities law, as amended by chapter 744 of the laws of 1970
Subdivision 2 ensures that for the purposes of this bill, the definition
of "PFAS" will be consistent with the definition found in the environ-
mental conservation law.
Section 1 of this bill also adds a subdivision 3 which allows the envi-
ronmental facilities corporation to award grants and loans to non-public
entities for water quality projects related to the removal of PFAS for
public water systems. This subdivision ensures that for the purposes of
this bill, the definition used for "public water systems" is consistent
with the relevant Department of Health regulations.
Section 2 of this bill establishes the effective date.
JUSTIFICATION:
This legislation is to provide authority which the Environmental Facili-
ties Corporation presently does not possess to provide, at its
discretion, grants and loans to non-public entities with public water
supplies for projects to remove harmful PFAS from their drinking water.
Given the recently reduced allowable thresholds for PFAS, non-public
entities are under enormous financial stress to comply with the more
stringent standards.
