TITLE OF BILL:
An act to amend the real property law, in relation to extending
protections to tenants of cooperative housing entities
PURPOSE:
Extends the applicability of certain housing provisions to tenant-share-
holders in cooperative housing corporations and other cooperative enti-
ties
SUMMARY OF PROVISIONS:
Section 1 creates a new section, 220-A, of the real property law
Section 2 sets forth the effective date
JUSTIFICATION:
Tenant-shareholders, despite technically being considered owners, occupy
units under proprietary leases, which are functionally identical to
standard residential leases. These residents pay monthly fees akin to
rent, rely on co-op boards functioning similarly to landlords, and are
subject to eviction proceedings for alleged violations. As such, if they
live as tenants and can be evicted as tenants, it thus follows that they
should be protected as tenants.
