TITLE OF BILL:
An act to amend the town law, in relation to the use of funds for the
acquisition of property for park, playground, and recreational facili-
ties and equipment
PURPOSE:
To allow the Town of Riverhead to use certain park funds for improve-
ment, expansion, repair, replacement or maintenance of parks.
SUMMARY OF PROVISIONS:
Section 1. Paragraph c of subdivision 4 of section 277 of the town law
is amended to allow certain lands to be set aside in public trust, based
on the findings of the planning board, for use as parkland.
Section 2. Paragraphs c and d of subdivision 6 of section 274-a of the
town is amended to allow certain lands to be set aside in public trust,
based on the findings of the planning board, for use as parkland.
Section 3. Sets the effective date.
JUSTIFICATION:
New York has long recognized that parks, playgrounds and recreational
facilities provide a great benefit to our citizens. This bill will
expand park and recreation fees to large scale commercial and industrial
subdivision and site plan, to allow park and recreation fees to be used
for repair and maintenance of existing parks. Currently, the law only
permits the use of these fees for new capital projects.
