TITLE OF BILL:
An act in relation to granting Gabrielle Tessler continued health cover-
age in retirement
SUMMARY OF PROVISIONS:
Section one of the bill states Gabrielle Tessler, who is an employee of
the NYC Board of Education, shall not be subject to local law number
nine of 2010 of the city of New York, shall be deemed to have become
employed by the board of education prior to April 27, 2010, and shall be
subject to clause (B) of subparagraph 3 of paragraph ii of subdivision a
of section 12-126 of the administrative code of the city of New York for
the purpose of determining vesting for health coverage in retirement.
Section two of the bill states that all costs pursuant to this act shall
be borne by the City of New York.
Section three of the bill includes the effective date.
JUSTIFICATION:
Gabrielle Tessler was hired as school nurses in January of 2014 by the
NYC Department of Health and Mental Hygiene. After three years, she was
offered the opportunity to transfer as a school nurse to the NYC Depart-
ment of Education. Before this transfer, they were informed that the
rule which allowed her to retire with full health benefits under DOHMH
would remain the same under DOE. After transferring departments she
learned there had been a rule change she was not informed of requiring
her to now work 15 years for the same benefit.
This bill would allow Ms. Tessler to be deemed employed by the Depart-
ment of Education to a prior date for the purpose of determining vesting
for continued health coverage.
