TITLE OF BILL:
An act to repeal section 3605-c of the public health law, relating to
authorization to enroll and provide medical assistance
PURPOSE:
This bill would repeal the Department of Health's contracting require-
ment for Licensed Home Care Services Agencies (LHCSAs).
SUMMARY OF SPECIFIC PROVISIONS:
Section 1 repeals Section 3605-c of the public health law which requires
LHCSAs to contract with the Department of Health in order to operate and
provide services within New York State.

JUSTIFICATION:
In 2020 the legislature put into effect restrictions on Licensed Home
Care Services Agencies (LHCSAs). In addition to the licensure require-
ment these agencies are required to operate in contract with the Depart-
ment of Health. Currently, due to the transition of the Consumer
Directed Personal Assistance Program (CDPAP) an estimated 60,000 indi-
viduals have left the CDPAP program to date and have opted to select a
traditional agency model. This model is provided by the LHSCAs and due
to the heightened dependence on LHSCAs it is imperative that the legis-
lature repeals the previously enacted contracting requirement to meet
the current needs of such agencies.
