TITLE OF BILL: CONCURRENT RESOLUTION OF THE SENATE AND ASSEMBLY
proposing an amendment to article 4 of the constitution, in relation to
declaring inabilities of the governor, lieutenant-governor and acting
governor
 
PURPOSE OR GENERAL IDEA OF BILL:
To create procedures in the constitution for declaring the governor,
lieutenant-governor, or acting-governor unable to discharge their powers
and duties.
 
SUMMARY OF SPECIFIC PROVISIONS:
This amendment adds a new section 9 to article 4 of the constitution
that allows the governor, lieutenant-governor, or acting-governor to
declare themselves unable to discharge the powers and duties of the
office. The amendment also creates a committee on gubernatorial inabili-
ty that can declare the governor, lieutenant-governor, or acting-gover-
nor unable. Through this amendment, the Legislature is authorized to
designate by statute six of the nine officials who will serve on the
committee alongside the three permanent members. Finally, this amend-
ment authorizes the Legislature to resolve disagreements between the
committee and the governor, lieutenant-governor, or acting-governor
about whether an inability exists.
Section 2: Sets effective date.
 
JUSTIFICATION:

EFFECTIVE DATE:
This act shall take effect on the same date as a "CONCURRENT RESOLUTION
OF THE SENATE AND ASSEMBLY proposing an amendment to article 4 of the
constitution, in relation to declaring inabilities of the governor,
lieutenant-governor and acting governor" takes effect, in accordance
with section 1 of article 19 of the constitution.
