TITLE OF BILL:
An act to amend chapter 198 of the laws of 2021, relating to authorizing
the use of existing village sewer rents for infrastructure projects
other than sewer projects in the village of Baldwinsville, in relation
to the effectiveness thereof
 
PURPOSE OR GENERAL IDEA OF BILL:
This legislation will allow for the Village of Baldwinsville to use
their sewer funds for other municipal purposes since the County of Onon-
daga is taking over the administration of the sewers.
 
SUMMARY OF PROVISIONS:
Section 1. Allows the village of Baldwinsville to use revenues from
their sewer fund towards municipality infrastructure improvements.
Revives Chapter 198 of 2021.
Section 2. Effective Date.
 
JUSTIFICATION:
Current law states a municipality's sewer rents, charges, penalties and
interest cannot be used for any purpose other than sewer related
purposes. This is in stark contrast to water utility funding which may
be credited to a municipality's infrastructure funding.
In Onondaga County, the County is consolidating all local municipal
sewer systems under the County. Due to the County taking over the main-
tenance and operation of the Baldwinsville sewers, the village of Bald-
winsville will no longer have need of a dedicated sewer fund.
Ultimately, this will prevent stranded assets in the Village's sewer
fund. Under this legislation, the Village of Baldwinsville will be
authorized to transfer sewer funds to other village infrastructure
projects over a period of a year, after which this law will be repealed.
