TITLE OF BILL:
An act to amend the criminal procedure law, in relation to designating
as peace officers dog control officers of the village of Holley
PURPOSE:
The purpose of this legislation is to provide dog control officers in
the village of Holley with peace officer status.
SUMMARY OF PROVISIONS:
Section 1 of this bill amends § 2.10 of the Criminal Procedure Law by
adding a new subdivision 88 to provide peace officer status to the dog
control officers in the village of Holley.
This will allow the village board to designate the dog control officer
as a constable for purposes of enforcement of Article 26 of the Agricul-
ture and Markets Law, and for the purpose of issuing appearance tickets
under Article 7 of the Agriculture and Markets Law.
JUSTIFICATION:
This legislation was introduced at the request of the village of Holley.
The village deems it important that its dog control officer have peace
officer status. The abilities that accompany peace officer status iden-
tified in Criminal Procedure Law § 2.20, will better help dog control
officers to recognize and investigate circumstances of abuse and cruelty
towards animals.
