TITLE OF BILL:
An act to amend the alcoholic beverage control law, in relation to an
exemption for certain property from the prohibition of alcohol sales
within a certain distance from a church
 
PURPOSE:
Exempts certain property from the prohibition of alcohol sales within a
certain distance from a church
 
SUMMARY OF PROVISIONS:
Section 1: Permits the State Liquor Authority to issue a retail license
for on-premises consumption for a premises which shall be located within
200 feet of a building occupied exclusively as a school, church, syna-
gogue or other places of worship, provided such premises constitutes a
premises located wholly within the boundaries of the county of Ontario
and falls within the bounds provided in this section; provides the
bounds and description of the exempted premises.
Section 2: Provides the effective date
 
JUSTIFICATION:
This bill will allow Dirty Jack's, located in Phelps, NY, to be issued a
liquor license despite their proximity to Saint Francis Church. Dirty
Jack's has been a stable establishment that provides excellent service
to the surrounding community. Allowing them to attain a liquor license
would support the continued success of the restaurant as well as
contribute to the growth of the community.
