TITLE OF BILL:
An act to amend the vehicle and traffic law, in relation to clarifying
that all trail users, including bicyclists, have right of way in cross-
walks wherever the multi-use trail crosses a roadway
 
PURPOSE:
Bill to clarify that bicyclists on multi-use trails have the right-of-
way when crossing a roadway within a crosswalk.
 
SUMMARY OF PROVISIONS:
Section 1. Amends 1151 of the vehicle and traffic law by adding a new
subdivision (d). Section 1151(d). Clarifies that all users of a multiuse
trail, including bicyclists, shall have the right of way when crossing a
roadway in a crosswalk.
Section 2. Sets the effective date.
 
JUSTIFICATION:
This bill makes technical changes to the vehicle and traffic law to
clarify that wherever a multi-use trail crosses a roadway, bicyclists as
well as pedestrians have the right of way to cross the roadway within a
crosswalk. Under current law, only. pedestrians are granted the right of
way, causing confusion and posing safety risks for bicyclists on multi-
use trails.
