TITLE OF BILL:
An act in relation to authorizing the village of Nyack to alienate and
discontinue the use of certain parklands
 
PURPOSE:
This bill would authorize the Village of Nyack to alienate certain park-
lands and to convey property interests in such lands for the purpose of
the construction of a restaurant.
 
SUMMARY OF PROVISIONS:
Section 1: Would authorize the Village of Nyack to alienate certain
parklands and to convey property interests in such lands for the purpose
of the construction of a restaurant.
Section 2: States that the authorization granted in Section 1 would only
be effective upon the condition that the Village of Nyack dedicate an
amount equal to or greater than fair market value of the parklands being
alienated pursuant to section one of this act towards the acquisition of
new parklands and/or capital improvements to existing park and recre-
ational facilities.
Section 3: Sets forth the certain plot, piece or parcel of land being
alienated in Section I.
Section 4: If the Village of Nyack receives any federal assistance or
funds for the purchase, maintenance or improvement of said parcel of
land enumerated in Section 1 herein, the alienation of such parklands
authorizes by Section 1, herein, shall not occur until the Village of
Nyack has complied with any and all federal requirements pursuant to the
alienation or conversion of parkland, including satisfying all of the
conditions set forth by the secretary of the interior.
Section 5: Effective Date
 
JUSTIFICATION:
The parcel of land being alienated was previously home to a restaurant,
but after operations ceased, the land was designated parkland during the
construction of the Mario M. Cuomo Bridge. This bill would allow the
Village of Nyack to return the land to its previous purpose of hosting a
waterfront restaurant.
