TITLE OF BILL:
An act authorizing the town of Hurley to alienate certain parklands for
use as a highway garage for the town and to dedicate other lands as
replacement parklands
 
PURPOSE:
To authorize the town of Hurley to alienate certain parklands for the
construction of a new highway garage and requires the town designate an
equivalent amount of land as parkland.
 
SUMMARY OF PROVISIONS:
Section one authorizes the Town of Hurley to alienate town parkland for
the purposes of constructing a new highway garage for the town.
Section two requires the town to dedicate specific lands as parkland in
replacement of the lands it is alienating.
Section three describes the boundaries of the land to be alienated.
Section four describes the land to be designated as parkland.
Section five requires the town to use an amount equal to the difference
in the fair market value of both pieces of land, if the land being
alienated is more valuable than the land being designated as parkland,
to improve or expand parkland.
Section six requires the Town of Hurley to meet with any federal regu-
lations pertaining to the alienation of parkland, if applicable.
Section seven states the effective date.
 
JUSTIFICATION:
The Town of Hurley has requested the alienation of a portion of parkland
so that they are able to construct a new highway garage for the town.
Their previous garage had numerous issues, most notably the fact that it
was located adjacent to a state superfund site, which resulted in the
town closing the garage. In the interim, the town is leasing a garage
for their highway operations at a cost of approximately $84,000 per
year, but they would like to construct a new one to save residents money
in the long term. The town has identified the best location to construct
this new garage, but since it is located on parkland, the town requires
state authorization to alienate it and begin construction. This bill
authorizes the town to alienate a section of parkland on the condition
that it designates a new parcel of approximately equal size as parkland.
