TITLE OF BILL:
An act to amend the vehicle and traffic law and the state finance law,
in relation to used motor vehicle dealer education
PURPOSE:
This legislation would require the Commissioner of the Department of
Motor Vehicles to establish used motor vehicle dealer training programs
for eligible used motor vehicle dealers
SUMMARY OF SPECIFIC PROVISIONS:
Section 1 adds a new section 419-b to the vehicle and traffic law.
Section 2 adds a new section 99-ss to the state finance law.
Section 3 is the effective date.
JUSTIFICATION:
New York is the national leader in consumer protection in almost every
area except in used motor vehicle education. New York is one of the few
States that does not require mandatory pre-licensing or continuing
education for dealerships. New York dealers are not required to be
educated in the functionality of opening a dealership, state and federal
laws, motor vehicle regulations, proper forms, disclosure, titling,
finance & insurance, vehicle financing & registration, motor vehicle
financing, sales tax, odometers, use of VERIFI, ethics, and advertising.
No mandatory education creates a lack of protection for consumers and
industry. Dealers unaware of the above are getting violations and going
out of business.
Mandatory pre-licensing and continuing education would benefit the
consumers and dealers.

EFFECTIVE DATE:
This act shall take effect on the thirtieth day after it shall have
become a law.
