TITLE OF BILL:
An act to amend the real property law, in relation to lease-hold retire-
ment communities
PURPOSE:
This legislation makes a local lease-hold retirement community in
Suffolk County subject to provisions of Section 233-b of the Real Prop-
erty Law relating to rent increases.
SUMMARY OF PROVISIONS:
Section 1. Amends the Real Property Law by adding a new Section 238-b to
define a lease-hold retirement community in Suffolk County.
Section 2 amends subdivision 1 of Section 233-b of the Real Property Law
to subject this lease-hold retirement community to the provisions relat-
ing to rent increases for manufactured home park rent increases.
Section 3 provides a Severability Clause
Section 4 provides that nothing herein shall prohibit a county from
enacting more stringent standards for a lease-hold retirement community
than are established in section one of this act.
Section 5. Effective Date.
JUSTIFICATION:
Greenwood Village is a residential community for adults 55 years of age
and older in Suffolk County that has a unique lease-hold structure simi-
lar to those that exist in manufactured home parks. This bill would
afford to individuals residing in this lease-hold retirement community
the same protections as persons who reside in manufactured home parks.

EFFECTIVE DATE:
This act shall take effect on the first of, October next succeeding the
date on which it shall have become a law and shall apply to sales,
actions or leases involving lease-hold retirement community homes occur-
ring or entered into on or after such date.
