TITLE OF BILL:
An act to amend the alcoholic beverage control law, in relation to an
exemption for certain property from the prohibition of alcohol sales
within a certain distance from a church
PURPOSE OR GENERAL IDEA OF BILL:
This bill will authorize issuance of a retail license for on-premises
consumption of alcohol for a certain property located within Rochester,
New York
SUMMARY OF PROVISIONS:
Section 1: Subdivision 7 of section 64 of the alcoholic beverage control
law is amended by adding a new paragraph (e-17) to authorize the issuing
of a retail license for on-premises consumption for a premises which
shall be located within two hundred feet of a building occupied as a
church, synagogue or other place of worship, provided such premises
constitute a premises for the sale of food or beverages at retail for
consumption on the premises located wholly within the boundaries of
Monroe County.
Section 2: Establishes the effective date
JUSTIFICATION:
This bill will allow Angelina's restaurant in Rochester, NY to be issued
a liquor license despite their proximity to the Bible Baptist Temple.
Angelina's restaurant has been a stable establishment in the neighbor-
hood that provides an excellent service to the surrounding community.
Allowing them to attain a liquor license would support the continued
success of the restaurant as well as contribute to the growth of the
community. The leadership of Bible Baptist Temple has issued a letter
stating their full support for the issuing of a liquor license. .

This act shall take effect immediately.
