TITLE OF BILL:
An act to amend the election law, in relation to prohibiting the deliv-
ery of an absentee ballot or an application therefore to an address
associated with a candidate's campaign
PURPOSE:
Prohibits the delivery of an absentee ballot or an application therefore
to an address associated with a candidate's campaign.
SUMMARY OF SPECIFIC PROVISIONS:
Section one amends paragraph (d) of subdivision 2 of section 8-400 of
the election law, as separately amended by chapters 273 and 746 of the
laws of 2021.
Section two amends subdivision 1 of section 8-406 of the election law,
as amended by section 2 of part HH of chapter 55 of the laws of 2022.
Section three sets forth the effective date.
JUSTIFICATION:
This legislation is the result of a recommendation from a New York State
Grand Jury report following an investigation that concluded that crimi-
nal absentee ballot activity was found in a primary race in Richmond
County in 2021. This legislation will improve and strengthen New York's
Election Law with respect to absentee ballots. This measure is necessary
to prevent such future illegal activity from occurring in New York
State. It will restore public faith in the electoral process by safe-
guarding every citizen's precious right to vote and ensure fair
elections.

EFFECTIVE DATE:
