TITLE OF BILL:
An act to repeal section 265.37 of the penal law relating to large
capacity ammunition feeding devices
PURPOSE:
Relates to resisting arrest.
SUMMARY OF PROVISIONS:
Section 1. Amends section 205.30 of the Penal Law to make resisting
arrest a class E felony.
Section 2. Amends Section 150.20 of the Criminal Procedure Law to add
resisting arrest to the list of E felonies and violations which a police
officer may arrest someone for instead of issuing an appearance ticket.
Section 3.Effective date
JUSTIFICATION:
In wake of the anti-police rhetoric where criminals are emboldened, this
bill increases the penalty for resisting arrest from a simple misdemea-
nor to a felony which sends a strong message that such behavior will not
be tolerated.
