TITLE OF BILL:
An act to amend the vehicle and traffic law and the public officers law,
in relation to owner liability for failure of an operator to comply with
stop signs in the village of Round Lake, county of Saratoga; and provid-
ing for the repeal of such provisions upon expiration thereof
PURPOSE OR GENERAL IDEA OF BILL:
To authorize the village of Round Lake to adopt a local law establishing
a stop sign photo violation monitoring demonstration program to impose
monetary liability on the owner of a vehicle for failure of the operator
thereof to stop for a stop sign in the village.
SUMMARY OF PROVISIONS:
Section one adds section 1172-a to the vehicle and traffic law to estab-
lish a stop sign photo violation monitoring demonstration program to
impose monetary liability on the owner of a vehicle for failure of the
operator thereof to stop for a stop sign in the village. Section two
amends section 87. of the public officers law to add subdivision (2)(v)
to prohibit the release of any photographs, microphotographs, videotape
or other recorded prepared under authority of VTL § 1172-a, such as
images identifying the driver, passengers or contents of a vehicle.
Section three establishes the effective date and repeal date of the act.
JUSTIFICATION:
There are a number Of intersections in the Village of Round Lake where
drivers often seek to "cut through" the Village to avoid other, busier
roadways. Unfortunately, it is also common for such drivers to fail to
come to a full stop at the stop signs in those intersections. The
Village has sought to slow drivers down by installing speed bumps and a
flashing stop light and has also periodically introduced a steady police
presence, to limited effect. Each of the relevant intersections is also
a school bus stop, and kids in the village need to cross George Avenue
to reach the very popular Malta/Round Lake Little League ballfield. Per
NYSDOT, the average daily volume on George Avenue is 1600 vehicles and
villagers routinely witness drivers ignoring the stop signs. Initiating
this demonstration program will enable the Village to begin consistently
imposing penalties on drivers that fail to observe the stop signs and
put pedestrians at risk.

EFFECTIVE DATE:
This act shall take effect on the thirtieth day after it shall have
become a law and shall expire and be deemed repealed five years after
such date.
