TITLE OF BILL:
An act to amend the county law and the executive law, in relation to
creating an appeals process for the district attorney
PURPOSE:
Relates to creating an appeals process for the district attorney.
SUMMARY OF PROVISIONS:
Section 1 amends Section 700 of the county law by adding a new subdivi-
sion 14, which enables victims and family members of a victim to appeal
the release of a person by the parole board to the District Attorney.
Section 2 amends Section 259-c of the executive law by adding a new
subdivision 18 to provide that the appeal go to the district attorney
offices.
Section 3 provides the effective date.
JUSTIFICATION:
As it stands, state law affords no opportunity for relatives of a victim
to challenge a Parole Board's ruling to release a defendant. This
amendment enhances the role of victim's family members in their search
for justice. This amendment provides that upon the release of a person
by the parole board, victims and family members of the victim or person
residing in the same county where such released person committed the
offense, may appeal the release to the District Attorney.

EFFECTIVE DATE:
This act shall take effect on the one hundred eightieth day after it
shall have become a law
