TITLE OF BILL:
An act authorizing the city of New York to discontinue certain parkland
in Ferry Point Park in the borough of the Bronx
SUMMARY OF PROVISIONS:
Section 1 alienates parkland per an agreement with Bally's for the
purpose of developing, constructing, maintaining, operating, using, or
occupying such lands with a gaming facility, and in conjunction with
such facility, commercial, retail, entertainment, recreational, golf,
hotel, convention center, and/or community facility uses, parking, and
roadways.
Section 2 specifies the alienation shall only be effective upon the
condition that Bally's is awarded or issued a gaming facility license
under title 2-A of article 13 of the racing, pari-mutuel wagering and
breeding law. In addition, the city of New York must dedicate new park-
land in an amount equal to or greater than the fair market value of the
land specified in Sections 3, 4, and 5 of this bill towards the acquisi-
tion of new parklands and/or capital improvements to existing parklands
and recreational facilities within the borough of the Bronx.
Sections 3, 4, and 5 carve out the area of the city of New York being
alienated; the coordinates of the certain land within Ferry Point Park
being alienated in the Bronx.
Section 6 clarifies the city of New York must comply with any federal
requirements pertaining to the alienation or conversion of parklands.
Section 7 mandates the alienated parkland use comply with the provisions
of article 13 of the racing, pari-mutuel wagering and breeding law and
sections 197-c and 197-d of the New York City charter pertaining to the
Uniform Land Use Review Procedure (ULURP).
Section 8 mandates if Bally's is awarded or issued a gaming facility
license, and construction of a gaming facility on the parklands is not
commenced within 15 years of the effective date of this act, or if the
land is used for any other purpose other than the one specified in this
act, the land shall revert back to the city of New York department of
parks and recreation to be used for park and recreational purposes.
Section 9 sets the effective date.
JUSTIFICATION:
To alienate certain land within Ferry Point Park in the borough of the
Bronx, discontinuing its current use and repurposing it for the project
as described in Section 1. This project will only be built if Bally's is
awarded/issued a gaming facility license, and if the city of New York
can create new parkland or start renovations on existing parkland within
the Bronx at the same net value of the fair market value of the speci-
fied land within Ferry Point Park. If Bally's does not build this
specific project within 15 years of this act's effective date, the land
will revert back to being owned by the the city of New York.
