TITLE OF BILL:
An act to amend the general business law, in relation to establishing
the artificial intelligence training data transparency act
 
PURPOSE OR GENERAL IDEA OF BILL:
To provide the public with information regarding the data used to train
certain artificial intelligence systems
 
SUMMARY OF PROVISIONS:
Section one describes the amendment to the general business law
Subsection fourteen-twenty provides a short title
Subsection fourteen-twenty-one provides definitions
Subsection fourteen-twenty-two describes the data that must be disclosed
when used to train generative artificial intelligence systems or
services
Subsection fourteen-twenty-three provides employee data protections
Section two establishes the effective date
 
JUSTIFICATION:
Based on a law in California, this legislation is designed to promote
transparency and accountability in the development and deployment of
generative artificial intelligence systems. As Al continues to influence
a wide range of industries, understanding the data used to train these
systems is crucial for ensuring that they are developed ethically,
responsibly, and in a manner that protects public interests. By requir-
ing developers to provide documentation detailing the datasets used to
train their Al systems, the bill ensures we are able to understand what
data underpins their functionality. This requirement will help identify
any biases, inaccuracies, or ethical concerns in the training data that
may impact the performance and fairness of Al systems, all while giving
consumers, regulators, and stakeholders the tools to better assess and
engage with these technologies.
Just as important, this bill is incredibly easy to comply with. Since
this measure is already law in California, any Al company that offers
its products to California businesses and/or consumers (which is to say,
nearly all of them) is already required to comply. By standardizing
legislation across states, the bill encourages innovation and provides
New Yorkers with valuable insight about how their data is used.
