TITLE OF BILL:
An act to amend the environmental conservation law; in relation to
directing state agencies to adopt a waste diversion plan
 
PURPOSE:
Directs state agencies to adopt a sustainability and decarbonization
program.
 
SUMMARY OF PROVISIONS:
Section 1 establishes definitions, and creates a GreenNY Council to
design and implement training and outreach programs in order to met the
requirements of this act. All affected entities must share data and
assist the council in any way deemed fit by the council.
By 2023, affected entities must use 100% energy eligible under the CES
("eligible systems") as part of an all-of-government approach to meet
the goals of the climate leadership and commuity protection act in a
cost-effective manner. Affected entities must follow a waste diversion
plan, which will be created by the council. With assistance from the
council, affected entities must evaluate and incorporate toxic use
reduction strategies into their operations. Affected entities must eval-
uate, and to the maximum extent practicable, incorporate green infras-
tructure concepts to reduce all stormwater runoff and improve water
quality in new construction or redevelopment projects. Affected entities
that have jurisdiction over real property must, when possible, seek
opportunities to enhance the ecological integrity of their real property
to support native biodiversity and habitat protection. The council will
continuously evaluate the potential of new technologies in order to
assist affected entities in continuing to reduce their environmental
footprint and increase climate resilience.
Section 2 states the effective date.
 
JUSTIFICATION:
In order to reduce waste and conserve natural resources, New York State
agencies must make strides to align agency practice with the sustaina-
bility goals of the state. This bill codifies Executive Order 22 issued
in September of 2022, which directs state agencies to adopt a sustaina-
bility and decarbonization program.
