TITLE OF BILL:
An act relating to disability retirement benefits for Dennis Malone, a
participant in World Trade Center rescue, recovery, and cleanup oper-
ations
 
PURPOSE:
This bill would allow Dennis Malone, a participant in the World Trade
Center rescue, recovery, and cleanup operations, to receive an acci-
dental disability benefit equal to 75 percent of final average salary.
 
SUMMARY OF PROVISIONS:
Section one of the bill allows Dennis Malone, a participant in the World
Trade Center rescue, recovery, and cleanup operations, to receive an
accidental disability benefit equal to 75 percent of final average sala-
ry pursuant to paragraph 4 of subdivision d of section 605 of the
retirement and social security law. Section two describers who is
responsible for any past costs. Section three relates to the effective
date.
 
JUSTIFICATION:
Following the September 11th attacks, Dennis Malone, working at the Town
of Clarkstown, participated in the recovery efforts and was incapaci-
tated as a result. This bill would allow him to receive an accidental
disability benefit equal to 75% of his final average salary.
